Initial Consultation This office offers a free initial consultation of up to 30 minutes.
Fees for Representation
Attorney’s fees are incurred in one of the following ways:
- hourly billing
- flat fee
- contingency fee
- percentage of estate

Costs You will be responsible for any out of pocket expenses for your case such as copying, postage, publication fees, service of process fees, court reporter fees, deposition transcript costs, subpoena fees, and filing fees. In hourly and flat fee cases, payment for costs is due prior to the cost being incurred. In contingency fee cases, payment for costs is made out of the settlement or award.
Retainers The majority of cases require an initial retainer before commencing work on your case. Retainer funds will be deposited into an escrow account and will not be withdrawn until it is earned. Each month the client is expected to pay their bill in full and therefore maintain their retainer at its original balance.
Additional Retainer You may be asked to increase your retainer prior to a trial, evidentiary hearing , when additional work is expected or if you have gotten behind in payment previously.
Keeping your Bill Current You will be expected to pay all your fees in full by the fifteenth of each month in order to maintain your retainer at its original balance.
Paid Consultations Consultations beyond an initial consultation are billed at our regular hourly billing rate and can be for whatever amount of time is required. Payment may be required at the time of service.
Hourly Fees If your case is billed at an hourly rate, you will be billed for the amount of time each person in our office spends working on your case. This includes time spent in communications such as phone calls, letters, and emails as well as time spent in meetings, drafting documents and reviewing the file while preparing a strategy or plan. Billing is done in 6 minute increments.
Billing for Hourly Fees You will receive a monthly statement detailing the action taken and work performed on your case and the amount of time spent on each action. Bills are mailed out on the 1st of each month.
Flat Fees If your case is billed as a flat fee, you are only responsible for the amount of the flat fee for the services provided regardless of the amount of time spent on your case. If you require services beyond those included in the flat fee amount, they may be billed at an hourly rate.
Contingency Fees In personal injury cases, fees are owed by the client only if the client recovers in their case. Fees are taken out of the recovery. The amount of the contingent fee is generally 33% for a settlement prior to litigation.
Percentage Fees For representation in an uncontested probate case, attorney’s fees are charged as 5% of the estate.
