McFarling Benson Wins Appeal at the Nevada Supreme Court
In the case of Ogawa vs. Ogawa, McFarling Benson presented both written briefs as well as oral arguments to the Nevada Supreme Court. In the Ogawa appeal, McFarling Benson represented a father who was wrongfully defaulted in his divorce and custody case. The case has been remanded to District Court for a new trial on all issues as a result of McFarling Benson’s appeal. The Nevada Supreme Court's decision can be viewed here.
An appeal is a review by a higher court of a lower court to determine if the lower court made a legal mistake. An appeal is not a new trial or a chance to introduce new evidence. The court will review the evidence, documents, audio recordings and appeal briefs from the hearing in the lower court to make a decision whether a mistake was made or evidence was withheld.
