Criminal Law

DO NOT SPEAK ABOUT YOUR CASE WITH ANYONE INCLUDING LAW ENFORCEMENT WITHOUT CONSULTING AN ATTORNEY.

Immediately after you are charged with a crime, you need an attorney to protect your rights. A highly skilled, experienced attorney can help you understand the laws and procedures related to a criminal violation. Our attorneys are eager to stand with you before the court and to ensure your rights are preserved.

We realize the lasting effects a criminal conviction may have, and will diligently seek the most favorable result in your case. With the advice of a McFarling Law Group attorney, you will make an informed decision regarding pursuing trial or accepting any plea negotiation.

Category of Crimes and Possible Sentences in Nevada:
  •   Misdemeanor: up to 6 months in jail and/or a $1,000.00 fine
  •   Gross Misdemeanor: up to 1 year in the county jail and/or a   $2,000.00 fine
  •   Felony: 1 year or more in state prison, and a possible fine. In most   cases, a judge may suspend sentencing in both felony and gross   misdemeanor cases and grant a term of probation. A felony   conviction has additional repercussions, including loss of certain   fundamental rights. A McFarling Law Group attorney will fight to   protect those rights.
Initial Meeting
At the initial meeting with a McFarling Law Group attorney you, or your loved one, will be treated with respect. This meeting provides you the opportunity to discuss your case freely, to meet with an attorney who will provide answers to your questions, and to give you the peace of mind that a caring and competent staff is working on your case. Please bring with you any paperwork provided by the police, the jail, or the court. If you are in custody, a McFarling Law Group attorney may assist your loved one with posting bail, or make arrangements for an in custody visitation.

Discovery and Investigation
After your initial meeting, an attorney will gather all of the information that the prosecutor has that is relevant to your case. This is called discovery. Once discovery has been completed, a McFarling Law Group attorney will be able to assess your case and will meet with you to discuss the evidence, the need for further investigation, and the best way to represent you in your case. Whether you decide to enter into plea negotiations or proceed to trial, the McFarling Law Group will work to protect your rights and aggressively defend you throughout the entire process.

Sentencing Hearings
If you find yourself convicted of a criminal offense, you need an attorney to assist you in the sentencing phase. A knowledgeable attorney who provides personal attention could mean the difference between a prison/jail sentence and a probation grant. A McFarling Law Group attorney will provide that necessary personal attention and seek the best outcome for your case.

Nevada Probation Discharges
If you have completed at least half of your probation grant and all of your special conditions, you may be eligible for an early discharge from probation. A McFarling Law Group attorney can help you decide whether to seek an early discharge from the court.

Nevada Probation Violation Holds
Probation violation charges often lead to arrest and the placement of a probation hold. If you have a probation hold, you may remain in custody without bail until your revocation hearing. You may also qualify for house arrest while you await a revocation hearing. A McFarling Law Group attorney will negotiate for your release or admittance to an appropriate program.

Parole and Probation Revocation Hearings
Whether you face charges of violating the conditions of probation, or will be facing the Parole Board, you need an attorney to gather evidence of successful rehabilitation and to provide the court or board alternatives to lengthy prison sentences. A McFarling Law Group attorney will gather this evidence and work with you to fight for your reinstatement.

Appeals
The McFarling Law Group can help you with the appeal process. If you have been convicted of a crime, do not wait to discuss your options for appeal.
