Family Law Fees

Initial Consultation
This office offers an initial consultation of up to 30 minutes for a flat fee of $100

Types of Fees Following an initial consultation, this office will often be able to estimate the amount and type of fees your case may require. The majority of cases are billed at an hourly rate with a retainer required up front. Flat fees are charged for cases that do not involve disputes.

Billing
You will receive a monthly statement detailing the action taken and work performed on your case and the amount of time spent on each action. Bills are mailed out on the 1st of each month.

Flat Fees
If your case is billed as a flat fee, you are only responsible for the amount of the flat fee for the services provided regardless of the amount of time spent on your case. If you require services beyond those included in the flat fee amount, they may be billed at an hourly rate.

Hourly Fees
If your case is billed at an hourly rate, you will be billed for the amount of time each person in our office spends working on your case. This includes time spent in communications such as phone calls, letters, and emails as well as time spent in meetings, drafting documents and reviewing the file while preparing a strategy or plan. Billing is done in 6 minute increments.

Costs
You will be responsible for any out of pocket expenses for your case such as copying, postage, publication fees, service of process fees, court reporter fees, deposition transcript costs, subpoena fees, and filing fees.

Retainers
The majority of cases will require an initial retainer before commencing work on your case. All litigation and family law matters will require an initial retainer. Retainer funds will be deposited into an escrow account and will not be withdrawn until it is earned. If we are able to resolve your matter prior to depletion of the funds, you will receive a refund of whatever amount has not been earned by this office. The amount of the initial retainer amount is calculated based on the information you have provided about the complexity of your case and your ability to pay. It is impossible to accurately guess the cost of most family law matters. Many law offices require very high initial retainers when it is hard to predict the total fees. Our office tries to work with clients who may have limited means by requiring less payment up front. If this is the case, it is very likely that your total fees will exceed your initial retainer amount. If your fees exceed your initial retainer, you will be responsible for these additional fees either by submitting an additional retainer, paying off a balance owed or setting up a payment plan. We strongly encourage you to pay as much as possible in an initial retainer so that it is easier to keep your bill current.

Payment Plans
If an initial retainer is not sufficient to keep your bill current throughout the duration of your case, you may be set up with a payment plan. Payments plans are set up around your payment schedule. If you are paid monthly, then a monthly schedule can be set up. If you are paid weekly or bi-weekly, your payment plan can be set up around this schedule. Depending on the expected fees for your case, a payment plan will be arranged for up to the maximum amount you are able to pay on any given pay period.

Additional Retainer
If your fees are such that a payment plan would not be able to keep you reasonably current, you may be asked to submit an additional retainer once your initial retainer has been used.

Keeping your Bill Current
Unless you set up a payment plan or submit an additional retainer, you will be expected to pay all your fees in full within 30 days of receiving a bill.

Billed Services
For continuing clients who keep their accounts paid in full and clients with relatively small matters, our office may not require an initial retainer, but may send out monthly billing statements for any current amounts due.

Consultations
Consultations beyond an initial consultation are billed at our regular hourly billing rate and can be for whatever amount of time is required. Payment may be required at the time of service.

Flat Fees
For certain types of matters such as joint divorces, a client may request to be billed a flat fee instead of an hourly rate. This option is only available for types of cases that do not involve disputes.

FEE SCHEDULE

The retainer amounts listed in the fee schedule below just gives a ballpark of what to expect. All cases are different and require very different amounts of work. The amount of work required for a case depends on many things including:

whether the other party has an attorney
who the judge is
how big of a dispute there is
how much communication a client requires from the attorney representing them

Your retainer may be adjusted to fit your particular case.
